The Extension of Representative of an Overseas Business, Tier-1 Entrepreneur and Tier-1 Investor Visa

While some of the key business and investor immigration routes to the UK are now closed to new applicants, individuals already on these visas can still extend their stay or apply for settlement (Indefinite Leave to Remain – ILR). The routes affected include the Representative of an Overseas Business Visa, the Tier 1 Entrepreneur Visa, and the Tier 1 Investor Visa.  This ensures that those who have made significant contributions to the UK economy through business or investment are able to continue living and working in the UK.

Representative of an Overseas Business Visa Extension

If you hold a Representative of an Overseas Business Visa (often referred to as the Sole Representative Visa), you can apply to extend your visa for another two years, provided you continue to meet the eligibility criteria.

This visa allows senior employees of overseas businesses to establish a branch or subsidiary in the UK. Extensions depend on proving that the UK branch has been set up, is operational, and that the visa holder is still required in the UK.

The Representative of an Overseas Business visa is still open to new applicants for those who are employees of overseas newspapers, news agencies or broadcasting organisations posted on long-term assignments to the UK. Representatives of an overseas business planning to set up its first UK branch or wholly-owned subsidiary need to apply for the UK Expansion Worker visa instead.

Tier 1 Entrepreneur Visa Extension

Although the Tier 1 Entrepreneur Visa route has closed to new applicants, current visa holders can still apply for extensions, provided they meet specific criteria. To extend your visa, you will need to demonstrate that you have invested the required funds into your UK business, created jobs for settled workers, and that your business is operational and growing.

Tier 1 Investor Visa Extension

The Tier 1 Investor Visa route, which previously allowed high-net-worth individuals to make significant financial investments in the UK, is also closed to new applicants. However, if you are already in the UK on this visa, you can apply for an extension (or settlement). To qualify for an extension, you must prove that your investment remains at the required level and that you continue to meet the conditions of your visa.
